When Green = Disaster?

I’ve been hearing a few reports regarding disaster declarations in facilities that are developed using green building practices.  This is an interesting one.  The premise is that automatic flush/energy-saving toilets are often not on generator backup.  Therefore, local health officials can close the building because of the health risk posed by non-flushing toilets.  The enterprise then has a workforce continuity outage and might have to declare a disaster.  I thought health codes require a backup system for sanitation systems?
